Our School Policies

Scope

Freeway Truck & Forklift Training Academy inc. is committed to providing our students with an educational environment free from sexual violence and treating those students who report incidents of sexual violence with dignity and respect.

Purpose and Intent

The students of Freeway Truck & Forklift Training Academy inc. have the right to study in an environment free of sexual violence.

This document sets out our policy on sexual violence involving our students, defines the prohibited behaviours, and outlines our investigative processes for sexual violence. This policy applies to complaints of sexual violence involving our students – at the campus of Freeway Truck & Forklift Training Academy inc. or at a one of our events.

Definition of Sexual Violence

This policy prohibits sexual violence which means any sexual act or act targeting a person’s sexuality, gender identity or gender expression whether the act is physical or psychological in nature, that is committed, threatened, or attempted against a person without the person’s consent, and includes sexual assault, sexual harassment, stalking, indecent exposure, voyeurism, and sexual exploitation.

Policy Objectives

Freeway Truck & Forklift Training Academy inc. provides this copy of the policy to our students, and educates them together with our career college management, employees, and contractors about this policy and how to identify situations that involve or could progress into sexual violence against our students and how to reduce it.

Where a complaint of sexual violence has been made, under this policy, Freeway Truck & Forklift Training Academy inc. will take all reasonable steps to investigate it, including the following:

  • providing on-campus investigation procedures to students for sexual violence complaints
  • responding promptly to any complaint and providing reasonable updates to the complainant and the
  • respondent about the status of the investigation
  • assisting students who have experienced sexual violence in obtaining counseling and medical care
  • providing students who have experienced sexual violence with appropriate academic and other accommodation.
  • providing students who have experienced sexual violence with information about reporting options.

It is the responsibility of the corporate directors, controlling shareholders, owners, partners, other persons who manage or direct the affairs of Freeway Truck & Forklift Training Academy inc., agents, students, instructors, and other employees to report any sexual violence upon becoming aware of incidents or complaints of sexual violence.

Reporting and Responding to Sexual Violence

Students and staff of Freeway Truck & Forklift Training Academy inc. will take all reasonable steps to prevent sexual violence on our career college campus or events by reporting immediately to an instructor or Manager if our students have been subject to, or they have witnessed or have knowledge of sexual violence involving our students or have reason to believe that sexual violence has occurred or may occur involving our students.

Freeway Truck & Forklift Training Academy inc., to the extent it is possible, will investigate all reports of sexual violence. Freeway Truck & Forklift Training Academy inc. will attempt to keep all information disclosed confidential except in those circumstances it believes an individual is at imminent risk of self-harm, or of harming another, or there are reasonable grounds to believe that others on our campus or the broader community are at risk.

Freeway Truck & Forklift Training Academy inc. acknowledges that the victim may choose not to request an investigation by Freeway Truck & Forklift Training Academy inc. and that a victim has the right not to participate in any investigation that may occur. However, in certain circumstances, Freeway Truck & Forklift Training Academy inc. may be required by law or its internal policies to initiate an internal investigation and/or inform police without the complainant’s consent, if it believes the safety of members of its campus or the broader community is at risk. Anyone involved in the investigation may ask another person to be present during every stage of the process.

A complainant acting in good faith, who discloses or reports sexual violence, will not be subject to actions for violations of the institution’s policies related to drug and alcohol use at the time the sexual violence took place.

During the institution’s investigative process, students who share their experience of sexual violence through disclosing, accessing support, and/or reporting to the university or college, will not be asked irrelevant questions from institution’s staff or investigators, such as those relating to past sexual history or sexual expression.

It is a violation of this policy to retaliate or threaten to retaliate against a complainant who has brought forward a complaint of sexual violence, provided information related to a complaint, or otherwise been involved in the complaint investigation process.

Accommodations

Freeway Truck & Forklift Training Academy inc. will make accommodations to meet the needs of any student effected by sexual violence. The student must contact Taranjit Singh Karwal or a representative of our management team to begin the process. Students are not required to submit a complaint or formal report of a sexual violence incident to request accommodations.

Freeway Truck & Forklift Training Academy inc. will determine an appropriate accommodation on a case-by-case basis at no cost to the student.

Investigating Reports of Sexual Violence

  • A complaint of sexual violence may be filed under this policy, by any student of Freeway Truck & Forklift Training Academy inc., to Taranjit Singh Karwal, Director using the contact information 647-515-1993

A management representative of Freeway Truck & Forklift Training Academy inc. will be involved in each stage of an investigation and decision-making process.

Upon a complaint of alleged sexual violence being made Freeway Truck & Forklift Training Academy inc. will initiate an investigation, including the following:

  • meeting with the complainant to determine the date and time of the incident, the persons involved, the names of any person who witnessed the incident and a complete description of what occurred.
  • determining whether the incident should be referred immediately to police.
  • determining what interim measures, if any, need to be taken during the investigation (for example: remote classroom)
  • interviewing the complainant, any person involved in the incident and any identified witnesses.
  • interviewing any other person who may have knowledge of incidents related to the complaint or any other similar incidents.
  • informing the respondent of the complaint, providing details of the allegations, and giving the respondent an opportunity to respond to those allegations.
  • providing reasonable updates to the complainant and the respondent about the status of the investigation
  • determining what disciplinary action, if any, should be taken.

To ensure procedural fairness Freeway Truck & Forklift Training Academy inc. will include the following elements in any investigation and its decision-making process:

  • Processing without undue delay
  • The right to fair and impartial decision-making
  • The Complainant’s right to be heard.

Disciplinary Measures

If it is determined by Freeway Truck & Forklift Training Academy inc. that a student of our college has been involved in sexual violence, immediate disciplinary or corrective action will be taken up to and including termination of employment of instructors or staff or expulsion of a student.

In cases where criminal proceedings are initiated, Freeway Truck & Forklift Training Academy inc. will assist police agencies, lawyers, insurance companies, and courts to the fullest extent.

Where criminal and/or civil proceedings are commenced in respect of allegations of sexual violence Freeway Truck & Forklift Training Academy inc. may conduct its own independent investigation and make its own determination in accordance with its own policies and procedures.

Appeals

Should the Complainant or the Respondent not agree with the decision resulting from the investigation, he or she may appeal the decision to the owner of Freeway Truck & Forklift Training Academy inc. within ten days by submitting a letter addressed to the owner advising of the person’s intent to appeal the decision.

Policy Review

This policy is reviewed every three years, at the time of review input from students will be taken into consideration. This policy will be reviewed again in September 2024.

FREEWAY TRUCK & FORKLIFT TRAINING ACADEMY INC. is committed to taking all reasonable steps to ensure the students have the opportunity to successfully complete their programs. FREEWAY TRUCK & FORKLIFT TRAINING ACADEMY INC. has a commitment to ensure that within this general framework that all students are treated fairly and equitably. Students who do not support the academic and ethical goals of the College for themselves and their fellow students may be subject to penalties, up to and including expulsion.

FREEWAY TRUCK & FORKLIFT TRAINING ACADEMY INC. will attempt to resolve a situation without expulsion. Verbal warning, written warnings and suspension may precede this final and most serious of actions. Where FREEWAY TRUCK & FORKLIFT TRAINING ACADEMY INC. deems the integrity, safety or well being of students, staff, clients, visitors and other guests is in danger then expulsion may be applied at FREEWAY TRUCK & FORKLIFT TRAINING ACADEMY INC.’s discretion at any point in the process.

The following outlines the conditions under which a student may be expelled with cause:

  1. Academic Dishonesty– students may be subject to expulsion at the discretion of FREEWAY TRUCK & FORKLIFT TRAINING ACADEMY INC.for academic dishonesty. Academic dishonesty is any word, action or deed performed alone, or with others for the direct or indirect intention of providing an unfair advantage or benefit to self or other student(s) including:
    • Cheating
    • Plagiarism
    • Unapproved collaboration
    • Alteration of records
    • Bribery
    • Lying
    • Misrepresentations
  1. Outstanding Fees– failure to pay tuition or other fees due to FREEWAY TRUCK & FORKLIFT TRAINING ACADEMY INC. is considered to be theft, and students who fail to remit outstanding fees may be expelled after written warning has been provided and the student fails to comply within the stated parameters.
  1. 3.Significant Omissions or Errors in Admissions Documentation– FREEWAY TRUCK & FORKLIFT TRAINING ACADEMY INC. has a responsibility to ensure students have been admitted in accordance with the registration requirements for the program. Students who knowingly or in error misrepresent their applications are subject to immediate expulsion.
  2. Academic Failure– students who fail to achieve the required academic standing in their programs may be expelled from the program. FREEWAY TRUCK & FORKLIFT TRAINING ACADEMY INC. may at its discretion offer alternatives to a student.  
  3. Attendance– students who do not achieve the required attendance as stated in the College policy are subject to expulsion.
  4. Harassment or Discrimination– FREEWAY TRUCK & FORKLIFT TRAINING ACADEMY INC. does not condone harassment or discrimination of any student, staff, client or visitors. Students participating in harassing or discriminatory activities are subject to immediate suspension pending investigation. Expulsion is mandatory for any student who is deemed by the investigation to have engaged in harassing or discriminatory activities.

 

In determining what constitutes harassment or discrimination, FREEWAY TRUCK & FORKLIFT TRAINING ACADEMY INC. refers to The Ontario Human Rights Code. Students requiring more specific information may refer to the specific code as posted on the Provincial web site.

  1. Misuse of College Property– College property is for the provision of College services. Students who damage, misuse, steal or otherwise use the property in a way that is prohibited may be expelled and required to make restitution.
  1. Endangerment of Staff or Students FREEWAY TRUCK & FORKLIFT TRAINING ACADEMY INC. is committed to the right of all College staff, students, clients and visitors to be safe. Students who by action or neglect in any way endanger the safety of themselves or others may be expelled.

Prior to expulsion, depending on the severity and nature of the situation, FREEWAY TRUCK & FORKLIFT TRAINING ACADEMY INC. may take intermediate steps at its discretion including:

  • Verbal warning
  • Written warning
  • Suspension
  • Expulsion

Notification 

Students who are subject to expulsion for any reason will be notified in writing, either hand delivered or by registered mail with return receipt. FREEWAY TRUCK & FORKLIFT TRAINING ACADEMY INC. is not responsible for non-delivery by registered mail if the student has not provided a valid home address where the student currently resides.

The notification will contain a description of the basis for expulsion and the effective date. Expelled students who dispute the facts of the expulsion must appeal the decision within three days of the notification following the complaints procedure of FREEWAY TRUCK & FORKLIFT TRAINING ACADEMY INC. provided to the student and providing sufficient proof to support the complaint.

Students who file an appeal and are unsuccessful are considered withdrawn from FREEWAY TRUCK & FORKLIFT TRAINING ACADEMY INC. Further appeals must be filed through the Complaints process of the Ministry Advanced Education and Skills Development, provided the students are attending a registered program recognized as being protected under the Private Career Colleges Act 2005.

Fees  

A student who is expelled by FREEWAY TRUCK & FORKLIFT TRAINING ACADEMY INC. will be considered withdrawn from their program on the effective date of the expulsion. The fee refund is pursuant to the fee refund policy.

Return of Property  

A student who is expelled is responsible for the return of any College property in his/her own possession within 10 days and will be held financially responsible for any property not returned in good condition or as outlined in the student contract. 

Every Student will be provided with a copy of this procedure when they enter into a contract with FREEWAY TRUCK & FORKLIFT TRAINING ACADEMY INC..  When a student at FREEWAY TRUCK & FORKLIFT TRAINING ACADEMY INC. is not satisfied, they can follow the student complaint procedure:

Step 1:

The student must request a meeting with the Instructor responsible for the course to discuss the complaint verbally (meeting should occur within 3 days of the request) if not resolved at this level, the student will follow Step 2

Step 2:

The student must submit a completed written complaint to the Administrator of FREEWAY TRUCK & FORKLIFT TRAINING ACADEMY INC. using the following contact information:

  • The administrator will arrange a meeting with the student within 2 days of receipt of the written complaint. The student will have an opportunity to make an oral presentation of the complaint at this meeting and to have another person present or another person make the oral presentation on their behalf.  This meeting will be documented by way of formal written minutes.
  • The administrator will provide a written response to the student outlining the discussion and any proposed and/or agreed upon solutions within 3 days of the meeting. This response will include a decision statement, together with the reasons on which the decisions is based and minutes of meetings held
  • The Administrator will review all aspects of this process before the final response is given:
  • Interviews with all applicable parties to the complaint
  • A review of all policies and guidelines relating to the complaint
  • The administrator will arrange a meeting with the student, within 3 days, to review the decision made by the administrator. At this time, the student will be able to review the decision and request further information if needed (this meeting should include the Administrator’s response with recommended solutions and the student’s objections or comments regarding these solutions.)
  • If the student is not satisfied with the decision made by the administrator, and the reasons for the decision, then they can have the complaint appealed to the owner of FREEWAY TRUCK & FORKLIFT TRAINING ACADEMY INC. (noted below in Step #3).
  • The complaint will remain at the school for a minimum of 3 years after a decision has been reached
  • Student shall receive a copy of this complaint for their records

Step 3:

The student must submit a completed written complaint to the Owner of FREEWAY TRUCK & FORKLIFT TRAINING ACADEMY INC. using the following contact information:

Step 4:

If not resolved at this level, the student may submit a student complaint electronically to the Superintendent of Private Career Colleges through the PARIS System

This student complaint procedure is in accordance with O.Reg 415/06 of the Private Career Colleges Act

Student complaint procedure

  1. (1) The student complaint procedure required under section 31 of the Act shall include,

(a) a requirement that a complaint be made in writing;

(b) the person or persons, identified by position, who will decide whether to dismiss the complaint or make a

recommendation as to any further action in relation to the complaint;

(c) the process to be followed by the private career college in dealing with the complaint which shall include,

(i) giving the student making the complaint an opportunity to make oral submissions,

(ii) allowing the student to have a person present with the student at all stages of the proceedings, and

(iii) the right of the student to have the person referred to in subclause (ii) make the oral submissions on his or her behalf;

(d) a description of the manner in which complaints, submissions and decisions will be recorded;

(e) a maximum length of time that may elapse between the date the complaint is submitted and the date a decision is issued by the college;

(f) a requirement that the decision be delivered to the student in writing and include reasons;

(g) a procedure for reviewing a decision;

(h) a requirement that the college maintain a record of every complaint at the campus where the complaint originated for a period of at least three years from the date of the decision relating to the complaint, which record shall include a copy of the complaint, of any submission filed with respect to the complaint and of the decision; and

(i) a requirement that the college provide the student who makes a complaint with a copy of the record referred to in clause

(h). O. Reg. 415/06, s. 36 (1).

(2) If a student is not satisfied with a private career college’s resolution of his or her complaint in accordance with the procedure Setout in subsection (1), the student may refer the matter to the Superintendent and shall include in his or her application to the

Superintendent a copy of the record referred to in clause (1) (h). O. Reg. 415/06, s. 36

(3) A private career college shall, as a condition of its registration, file a copy of any changes to the procedure with the Superintendent. O. Reg. 415/06, s. 36 (3).

(4) A change to a private career college’s complaint procedure shall not come into effect until approved by the Superintendent. O. Reg. 415/06, s. 36 (4).

This document outlines Freeway Truck & Forklift Training Academy Inc. fee refund policy as prescribed under the Private Career Colleges Act 2005, s. 25 to 33 O.Reg. 415/06.

Full Refunds

In any of the following circumstances, you have a choice of cancelling a contract and making a written request for a full refund of fees paid for a program or accepting the shortcoming and continuing your training with Freeway Truck & Forklift Training Academy Inc.:

  • the college, while still operating, discontinues the program before you can complete the program
  • the college collects any fees for the program before the college is registered or before the program is

approved under the Private Career Colleges Act, 2005

  • the college collects more than $500 in fees before entering a contract with the student for the vocational program
  • you are expelled from the college in a manner or for reasons that are not permitted under the college’s expulsion policy
  • a total of more than 10% of the program is taught by unqualified instructors
  • the contract is rendered void

If Freeway Truck & Forklift Training Academy Inc. charges or collects any compulsory fee that is not published on the Service Ontario website or that is higher than what is published, you are entitled to a full refund of the unpublished fee or the difference in amount between what is published and what was collected. The same applies if the college charges or collects any optional fee that is not approved by the Superintendent of Private Career Colleges.

In addition, you also may seek a full refund if Freeway Truck & Forklift Training Academy Inc. or its representative makes certain types of untrue statements for the purposes of convincing you to enroll in the program and the statements constitute a fundamental breach of the contract. The categories of inappropriate statements include: a false or misleading statement, a statement that guarantees admission to or successful completion of the program, employment after graduation or the right to enter Canada or receive a student visa.

In the above cases the refund will be issued within 30 days of your notice to withdraw. If you do not make a request for a full refund within a reasonable time of finding out about the shortcoming, you may lose your right to make a claim for a refund.

Cooling Off Period

You can cancel a contract within two days of signing it if you deliver a written notice to Freeway Truck & Forklift Training Academy Inc.. You are entitled to a full refund of fees paid for the program, including any application fee, from the college.

Partial Refund Before a Program Begins

You are entitled to a partial refund of fees paid for a program if:

  • you provide notice to withdraw from the program before it begins, in this case the refund will be issued within 30 days of your notice to withdraw
  • you do not meet the program’s admission requirements before the program begins, in this case the refund will be issued within 30 days from the program start
  • the college cancels the contract for the program within 45 days of the start of the program because you do not attend the first 14 days of classes, in this case the refund will be issued within 45 days from the program start date. Freeway Truck & Forklift Training Academy Inc. will provide the student with written notice of the cancellation of the contract within 45 days of the program start

The amount of a refund under this subsection shall be an amount that is equal to the full amount paid by the student for the vocational program, less an amount equal to the lesser of 20% of the full amount of the fees and $500.

Partial Refund After a Program Begins

If you withdraw or are expelled from the vocational program within the first half of the program, the amount of the refund that Freeway Truck & Forklift Training Academy Inc. shall provide you shall be equal to the full amount of the fees paid in respect of the program less:

  • an amount that is equal to the lesser of 20 per cent of the full amount of the fees in respect of the program and $500.
  • and a portion of the fees in respect of the program that is proportional to the number of hours of instruction that have elapsed at the time of the withdrawal or expulsion. ( Reg. 415/06, s. 29 (3))

 

If you withdraw or are expelled from the vocational program after the first half of the program, Freeway Truck & Forklift Training Academy Inc. is not required to provide a refund.

Retention of Refund

Freeway Truck & Forklift Training Academy Inc. shall not retain, by way of deduction or set-off, any refund of fees payable to a student under this policy in order to recover an amount owed by the student in respect of any service or program other than a vocational program offered by Freeway Truck & Forklift Training Academy Inc..

Books and Equipment

In calculating a refund under this policy, Freeway Truck & Forklift Training Academy Inc. will retain the retail cost of books or equipment that was supplied to the student if the student,

  • fails to return the books or equipment to Freeway Truck & Forklift Training Academy Inc. within 10 days of the student’s withdrawal or expulsion from the program
  • returns the books or equipment to Freeway Truck & Forklift Training Academy Inc. within the 10-day period referred to above but fails to return it unopened or in the same state it was in when supplied

Refund for International Students

A notice to Freeway Truck & Forklift Training Academy Inc. that is provided by or on behalf of an international student or of a prospective international student and that states that the student has not been issued a temporary resident visa as a member of the student class under the Immigration and Refugee Protection Act (Canada) is deemed to be:

  • notice of a rescission of the contract, as identified in the cooling off period
  • if the notice is given within two days of receiving a copy of the contract

Currency

Any refunds will be issued in Canadian dollars.
